教育機會均等在台灣民主化的推展下,已被普遍認為是促進國家競爭力的重要因素,其不僅能增加文化的創造,並達成文化的繁衍,而且有助於導引社會的變遷,促成社會的流動,以獲得社會的全面發展,避免不同族群學生的標籤化。而現今台灣社會普遍存在的新移民子女教育,正是檢驗我國教育機會均等是否真正落實的機會。因此,教育機會均等不僅是一個教育理論,而且也是我國《憲法》明文規定的保障,故從《憲法》上社會國原則建構教育機會均等,成為教育機會均等在我國實踐的必然前提,因為教育行政的基礎在教育相關法規,而此等法規則根源於《憲法》規定。本文將嘗試以新移民子女為中心,從《憲法》上社會國原則建構教育機會均等,結合《憲法》第1條的民享原則與第159 條的教育機會均等,並根據《憲法》第21 條所建構的教育基本權,作為落實新移民子女教育機會均等的檢討基礎,進而架構《憲法》解釋的實際價值。
An equal educational opportunity in Taiwan's democratic movement is widely regarded as an important factor to improve national competitiveness.An equal educational opportunity is essential to foster cultural creations, to accomplish cultural development and diversification. Moreover, an equal educational opportunity is helpful to lead the social changes, to facilitate social flows to achieve a fully developed society, and to avoid different racial students from being labeled. The education of new immigrants' children may serve as an opportunity to examine whether students in Taiwan enjoy an equal educational opportunity. Therefore, an equal educational opportunity is not only a theory of education, but a constitutional protection. Because the basis of education administration is educational law and regulation, which in turn have their constitutional roots, in order to implement and provide an equal educational opportunity in Ta-iwan, to construct an equal educational opportunity from the constitution al principle of a social state becomes the inevitable premise. This article tries to emphasize on new immigrants' children and tries to construct an equal educational opportunity principle from the constitutional principle of a social state. Combining the for-the-people principle under Article 1 of the Constitution and the equal educational opportunity principle under Article 159 of the Constitution, this article uses the fundamental right to education as so structured under Article 21 of the Constitution as a basis to discuss the implementation of the equal educational opportunity on the education of new immigrants' children and tries to construct the true value of Interpretations of the Constitution.
