Le froid et le cruel)一書中曾指出，薩德與馬佐克的作品不應該只被視為「色情作品」(pornographie)，而是更高層次的「色情學」(pornologie)，這是因為他們的情色語言不只具備「命命」與「描述」等基本功能，而是具備更高層次的的語言功能，也就是一種「非人的」(impersonnel)語言。這種「非人的」文學形式似乎與「扭曲」的法律觀息息相關。因此，本文旨在剖析S(Sade)/ M( Masoch)之「非人的」情色語言與形式，並釐清施虐狂和受虐狂與法律之間弔詭之關係。

As Gilles Deleuze once said in Masochism, Coldness and Cruelty, Sade’s and Masoch’s works should not be seen as “pornography”, but at a higher level as “pornology”, because their erotic languages possess not only the elementary functions of ordering and describing, but also a higher function of an impersonal language. This language seems to have a close link to the conception of deformed laws. Drawing upon this observation, this paper analyzes Sade’s and Masoch’s impersonal erotic language and purports to resolve the paradoxical relation between laws and sadism-masochism.
