從累積的社會結構理論 看臺灣勞動政策的制定與施行:以《大量解僱勞工保護法》為例

這篇論文主要從累積的社會結構的三個面向,分別是勞資關係、國家角色和意識形態,檢視臺灣在1990年代採取彈性與保護的勞動制度是否可以降低勞資衝突及同時維持經濟成長。首先,作為保護層面的《大量解僱勞工保護法》最後朝向管制型的累積社會結構?或是自由型的累積社會結構?再者,本文透過宏達電、威航與復興航空的大量解僱個案,分析預告通知與協商制度是否有助於臺灣集體協商制度的發展,或僅是單方面強化雇主對於勞工的統治。最後,本文試圖指出《大量解僱勞工保護法》過度傾向自由型的累積社會結構,將有可能造成社會的自我保護運動的興起。
英文摘要
Based on the theory of the Social Structure of Accumulation, this study analyzes the Act for Worker Protection of Mass Redundancy from three perspectives: capital-labor contraction, the state role, and the dominant ideology. First, this study examines whether the Act for Worker Protection of Mass Redundancy belongs to the liberal Social Structure of Accumulation or the regulated Social Structure of Accumulation. Second, this study examines advance notification in a collective bargaining institution through a discussion of the three case studies. Finally, this paper proposes that the movement for the self-protection of society will come after the Act for Worker Protection of Mass Redundancy, which is toward the liberal Social Structure of Accumulation.
