中國傳統重刑與報應的觀念使得一般人民不贊成廢除死刑,官 方更以死刑當作是控制社會和維持政權的重要工具,這不僅影響著 中國刑法國際化的進展,也讓中國遲遲無法批准《公民與政治權利國 際公約》與廢除死刑的第二任擇議定書。本文發現,中國內部支持廢 除死刑的力量,正試圖採取同化的途徑讓中國官方與人民接受這股世 界潮流,而非暴力犯罪則是他們目前努力的方向;另外,來自於國際 的力量,也將扮演著勸服的角色,加速中國融入國際社會的規範之 中。
英文摘要
According to Chinese tradition, people always value the function of severe punishment and retribution. The Communists also use the death penalty as a tool for controlling society and maintaining their regime. This situation not only influences the process of the internationalization of China’s criminal law, but also results in China not approving the Second Optional Protocol to the International Covenant on Civil and Political Rights. This study first analyzes the meaning of abolishing the death penalty for China, and then tries to find the driving force in pushing China to consider it. It concludes that support for abolishing the death penalty in China can be obtained by attempting to acculturate the government and people to accept the trend and as outside forces also persuade China to comply with the norms of international society.
