本文從比較行政長官公署制度與國民政府「省制」及總督府體制 中權力之差異，探討臺灣省行政長官公署權力的特殊性。這種特殊性可 說是一種「軍事佔領接收體制」，最初目的是為佔領與接收時的權宜 措施，最終使命應是結束「殖民統治」，使臺灣享有正常的「憲政體 制」。長官公署利用其權力特殊性進行殖民統治改革，然而改革卻有 「虛」與「實」之問題，也因此政府運作與歷史使命間產生很大差距。 其中具體的問題與影響，為本文所欲探討的重點。 實際上，陳儀政府施政的目的，「財產的接收」遠甚於「統治事 務的延續」，實際的做法急於建立以國民黨外省官員為主的「直接統 治」，不僅日本官員被取代，甚至於下級的台籍公務員亦大量失業。並 在最短時間內遣送日本人，沒收日人龐大的公產與私產，以國民黨與外 省人取代日本人在臺灣經濟上的優勢地位。但另一方面對於戰後臺灣工 商業的重建復興，卻放任不顧，甚至於出售聯合國重建與救濟物資謀取 暴利。 這種利用權力特殊性，只為一黨政府與官員汲汲營利，無顧於為 民除弊興利，使長官公署成為實質的「奸商政府」。而此特殊性更保障 與強化外省官吏的權力以肆行其私慾，使臺灣成為貪污者的天堂。其結 果，在戰後不僅使長官公署淪為惡質「殖民統治」之濫觴，也使臺灣依 舊停留於「佔領狀態」。本文分別從接收、制度變革與實際行政三個角 度，探討上述問題。

This paper investigates and compares the power situations of the Office of Governor-General of Taiwan, the Governor General Administration in Taiwan under Japanese colony, and the Province Governor of China. As a result, the power situation of the Office of Governor-General of Taiwan proved to be a kind of military occupation administration. The mission of the Office of Governor-General of Taiwan was to end the colony system and led Taiwan into constitutional system of the Republic of China. However, the Office of Governor-General of Taiwan abused its power to satisfy its personal purpose; thus, leading to corruption and unemployment. The postwar relief and rehabilitation for Taiwan was seriously delayed, which sparked off the 228 incident. The purpose of this paper regards the Office of Governor-General of Taiwan as a kind of military occupation administration; furthermore, the paper intends to describe the problems and the issues the administration brought about.
